Terms of Service

1. Acceptance of Terms

By registering for, accessing, or using PETRA AI, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our services.

2. License Grant

Subject to your compliance with these Terms and payment of applicable fees, Viametrix grants you a limited, non-exclusive, non-transferable license to use PETRA AI.

Perpetual License: A one-time purchase grants you perpetual rights to use the licensed version, with maintenance and updates included for the contracted maintenance period.

Subscription License: An annual subscription grants you rights to use PETRA AI during the subscription term, including all updates and new features released during that period.

3. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble PETRA AI software
• Resell, sublicense, or redistribute the software without written permission
• Use the service to process data on behalf of third parties without a reseller agreement
• Attempt to circumvent security measures or access controls
• Use the service for unlawful purposes or in violation of applicable regulations
• Remove or alter proprietary notices, labels, or watermarks

4. Intellectual Property

PETRA AI, the PETRA AI™ name, logo, ROI methodology, AI models, vector encoding algorithms, and all related software are the exclusive intellectual property of Viametrix.

Your data — including uploaded DXF files, die specifications, and production records — remains your property. You grant Viametrix a limited license to process your data solely to provide the service.

5. Warranties and Disclaimers

Viametrix warrants that PETRA AI will perform substantially as described in the documentation. We do not warrant that the service will be error-free or uninterrupted.

THE SERVICE IS PROVIDED "AS IS" WITHOUT ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIAMETRIX'S TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. VIAMETRIX SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

7. Termination

Either party may terminate the agreement with 30 days' written notice. Viametrix may terminate immediately for material breach, including unauthorized use or non-payment.

Upon termination, your license to use PETRA AI ceases. Your data will be available for export for 30 days following termination, after which it will be deleted.

8. Governing Law

For customers located in Turkey: These Terms are governed by the laws of the Republic of Turkey. Disputes shall be resolved in the courts of Istanbul, Turkey.

For customers located in the European Union: These Terms are governed by the laws of the European Union and the applicable member state law. Disputes may be submitted to the competent courts of the customer's EU member state.
